Pop This Shop
Last updated: 16 October 2026
These Terms of Service (“Terms”) form a binding legal agreement between you and JEM Projects BV, a company organised under the laws of Belgium, with enterprise number (KBO/BCE) 0678.739.781 and VAT number BE 0678.739.781, registered office at Prins Boudewijnlaan 147, 2610 Wilrijk (“Pop This Shop”, “we”, “us” or “our”). They govern your access to and use of the Pop This Shop website, mobile applications and related services (together, the “Platform”).
Pop This Shop operates an online marketplace where businesses and individuals (“Landlords”) publish listings for temporary retail, market, exhibition or event space (“Space”, each a “Listing”), and where brands, makers, creators and other businesses and individuals (“Tenants”) find, book and pay for that Space (each booking, a “Reservation”). Tenants may also publish a listing of their own concept so that Landlords can find them. Landlords and Tenants are together “Members”.
By creating an account, browsing the Platform, publishing a Listing, or making or accepting a Reservation, you agree to these Terms and to our Privacy Policy, which explains how we collect and use personal data. If you do not agree to these Terms, you must not use the Platform.
1. Definitions
“Administration Fee” means the fee Pop This Shop charges for the use of the Platform, as described in Section 6.
“Advertiser” means a Member or other business that books a Featured Listing or a Banner on the Platform.
“Applicable Law” means Belgian law, applied as the primary legal framework governing these Terms, together with any European Union law that is directly applicable or that Belgian law implements, including in particular the General Data Protection Regulation (EU) 2016/679 (“GDPR”), the Digital Services Act (EU) 2022/2065 (“DSA”), the Platform-to-Business Regulation (EU) 2019/1150 (“P2B Regulation”), and the consumer protection provisions of Book VI and Book XII of the Belgian Code of Economic Law (“CDE”).
“Banner” means a paid image advertisement shown in a fixed position on the Platform, as described in Section 11.2.
“Concept Listing” means a Tenant’s presentation of its retail, pop-up or business concept, published on the Platform for Landlords to find, as described in Section 4.6.
“Content” means any text, images, logos, listings, reviews, messages, attachments or other material submitted by a Member to the Platform.
“Featured Listing” means a paid placement that shows a Listing or Concept Listing more prominently, as described in Section 11.1.
“First Contact” means the first message, offer, viewing request or booking request between a Landlord and a Tenant through the Platform, whatever its outcome.
“Landlord” means a Member who publishes a Listing offering Space.
“Listing” means a Landlord’s offer of Space published on the Platform.
“Monthly Rent” means the monthly rent agreed in a lease or, where there is none, the price of the Listing at the time of the First Contact, expressed per month (a weekly price multiplied by 4.33, or a daily price multiplied by 30).
“Protection Period” means the period of 2 years starting on the First Contact between a Landlord and a Tenant, as described in Section 10.7.
“Related Party” means any person or company that controls, is controlled by or is under common control with a Member, and any family member, employee, agent or business partner acting on that Member’s behalf.
“Reservation” means a booking of Space made by a Tenant through the Platform and confirmed by payment.
“Tenant” means a Member who searches for, books or uses Space, or who publishes a Concept Listing.
2. The Platform and Our Role
Pop This Shop provides an online venue where Landlords and Tenants find each other and conclude contracts for the temporary use of Space. The contract for the use of the Space (the rental agreement) is concluded directly between the Landlord and the Tenant. Pop This Shop is not a party to that contract, except for the collection and payment of amounts as described in Section 6.
Pop This Shop does not own, lease, control, manage or operate any Space listed on the Platform, and is not a real estate agent, event organiser, letting agent or insurer. We review Listings for compliance with our rules (Section 4.5), but we do not verify that a Landlord holds the rights, permits or licences needed to offer a particular Space. Members are responsible for satisfying themselves that a Listing or Reservation is lawful and fit for their purposes.
3. Eligibility and Member Accounts
You must be at least 18 years old and have the legal capacity to enter into binding contracts to create an account and use the Platform. When you register, you confirm that you are 18 or older and you give your year of birth. You must provide accurate, current and complete information and keep it up to date. You are responsible for keeping your login details confidential and for all activity under your account, and you must tell us promptly about any unauthorised use.
Where you register on behalf of a company or other organisation, you confirm that you are authorised to bind that organisation to these Terms.
We may ask you to confirm your identity through our payment service provider (Stripe) before you can publish a Listing, receive payouts or make certain payments. A badge on your profile shows when your identity has been checked or when a payment method is on file. A badge is not a guarantee about a Member or a Space.
4. Listings (Landlord Terms)
4.1 Creating and Managing a Listing
Publishing a Listing is free. Landlords are responsible for the accuracy of their Listing, including the description, photographs, availability, pricing, house or venue rules, and any restrictions on the use of the Space. Landlords must keep their availability up to date and must honour confirmed Reservations.
4.2 Know Your Legal Obligations
Landlords confirm that they hold the right (as owner, as leaseholder with a right to sublet, or otherwise) to offer the Space, and are solely responsible for obtaining and keeping any permits, licences, consents or insurance required under Applicable Law to offer the Space for the purposes described in the Listing. This includes, where relevant, municipal occupation permits, fire safety and public-event authorisations, and any licences needed for the sale of food, drink or other regulated goods (such as an FASFC/AFSCA registration or a communal alcohol licence). Landlords are also responsible for their own tax obligations, including VAT and income tax, arising from Reservations.
4.3 Search Results and Ranking
Search results reflect how relevant a Listing is to a Tenant’s search, taking into account factors such as location, dates, price, size, availability and reviews. Featured Listings (Section 11.1) are shown more prominently and are always marked as such. Where a Landlord is a business user within the meaning of the P2B Regulation, the main ranking parameters and their relative importance are explained in our Help Centre, in accordance with Article 5 of that Regulation.
4.4 Landlords Operating as a Business
Where a Reservation is concluded between a Landlord acting in a professional or business capacity and a Tenant acting as a consumer, the Landlord is responsible for providing the pre-contractual information required of a trader under Book VI CDE and the Consumer Rights Directive 2011/83/EU (including its identity, geographic address and contact details), and for complying with any applicable withdrawal-right rules.
4.5 Review of Listings
Every new Listing and every change to a published title, description or photos is reviewed before it goes online. The review combines an automated check of texts and photos (including an AI check) with a review by our team. Depending on the outcome, a Listing with a low risk level may be approved automatically, and a Listing with a medium or high risk level is always reviewed by a person. While a change is under review, the approved version stays online. Moving a Space by more than 250 metres or to another city also requires approval. If changes are needed, we send feedback explaining what to change and why. We never refuse a Listing on the basis of an automated check alone.
To protect both sides, the exact address of a Space is never shown publicly. The street name may not appear in a Listing, and the map shows an approximate area only. Contact details, payment instructions outside the Platform and other identifying information may not appear in Listings or photos (see Section 10.5).
Listings are never deleted by us. A Landlord can hide a Listing at any time, and we may hide or restrict a Listing in accordance with Section 10.4.
4.6 Concept Listings
A Tenant may publish a Concept Listing presenting its retail, pop-up or business concept, so that Landlords can find a Tenant suited to their Space. Concept Listings are anonymous: they describe the concept by category and style (for example, “sustainable fashion label from Antwerp”) and may not show the brand name, logo, website or other details that identify the Tenant. The brand is shared with a Landlord only when the Tenant sends that Landlord a booking request. Except where the context requires otherwise, the rules that apply to Listings in this Section 4 and elsewhere in these Terms apply equally to Concept Listings, with references to a Landlord and a Tenant read the other way round, as appropriate.
5. Booking Space (Tenant Terms)
5.1 Requests, Viewings and Confirmation
Tenants can search for Space by location, dates, size, price and other criteria, ask questions through Platform messages, request a viewing and send a booking request. Sending a request is free and nothing is charged until the Landlord accepts. A booking request that is not answered expires after 14 days.
A Landlord sees the full booking request (including the Tenant’s brand and project) after accepting the protection rules in Section 10.7 for that Tenant. A Landlord may decline a request without accepting them.
When the Landlord accepts, the Tenant receives a payment request. The Reservation is confirmed, and the contract between the Landlord and the Tenant is formed, when the payment is received. The rental agreement is signed online by both Members through the Platform.
A Tenant may book without visiting the Space first. In that case the Tenant confirms at checkout that the cancellation terms apply from the moment of payment, also if a later visit leads the Tenant to change its mind.
5.2 Pre-Contractual Information
Before a booking request is sent, the Platform shows the essential characteristics of the Space, the total price (including the Administration Fee, the payment processing fee and any applicable taxes) and the applicable cancellation terms, in line with Article VI.45 CDE and the Consumer Rights Directive. The identity of the Landlord is shared once the booking request has been accepted.
5.3 Right of Withdrawal
Where a Tenant is a consumer, Reservations for the use of Space on specific dates are, as a general rule, contracts for leisure-related or accommodation services to be performed on a specific date, and are therefore exempt from the standard 14-day withdrawal right under Article VI.53, 12° CDE and Article 16(l) of the Consumer Rights Directive. Cancellation is governed by Section 7 instead.
5.4 Check-in
On the start date, the Tenant confirms the check-in on the Platform. If the Tenant does not report a problem within 2 days of the start date, the stay is considered started.
6. Fees and Payment
6.1 Administration Fees
Creating an account and publishing a Listing or Concept Listing are free. Pop This Shop only charges an Administration Fee on a confirmed Reservation:
- Tenants pay an Administration Fee of 3% of the rent, with a minimum of €50, plus a payment processing fee of 3% of the amount paid, both plus VAT where applicable.
- Landlords pay an Administration Fee of 11% of the rent and any extras, with a minimum of €150, plus VAT where applicable.
The fees that apply to a Reservation are always shown before a booking request is sent or accepted. We may change our fees for future Reservations, with prior notice in accordance with Section 15 and Article 3 of the P2B Regulation.
6.2 Payments by Tenants
All payments for Reservations are made through the Platform. Pop This Shop collects the payment from the Tenant and pays the Landlord’s share to the Landlord, through our payment service provider Stripe and in accordance with Directive (EU) 2015/2366 (PSD2). Available payment methods include card, Bancontact, iDEAL, EPS, bank transfer and, in some countries, Pay by Bank. Card payments use strong customer authentication (3D Secure). For a first payment above €2.500, cards may not be accepted and another method is proposed. A Reservation paid by bank transfer is only confirmed once the transfer is received; if it is not received by the deadline shown, the request lapses and the dates become available again. Pop This Shop does not store full card details.
The price is shown and paid in the currency of the Listing. Amounts shown in another currency are approximate and for information only.
6.3 Longer Stays
For Reservations longer than one month, the Tenant pays the first month (plus any extras) and the Administration Fee for the whole stay at booking. Each following month is collected from the Tenant’s bank account 60 days before that month starts, after a reminder. If a collection fails, it is retried. If a monthly amount remains unpaid, the Landlord may choose to end the Reservation from the unpaid month, which is treated as a cancellation by the Tenant under Section 7.1.
6.4 Payouts to Landlords
To receive payouts, a Landlord sets up a payout account with Stripe. Payouts are made after each rental month: 30 days after the end of the month for a Landlord’s first 5 completed Reservations, and 14 days after the end of the month after that. Amounts a Landlord owes to Pop This Shop (for example a cancellation penalty or an amount under Section 10.7) may be deducted from later payouts.
6.5 Landlord Card Authorisation
To publish a Listing, a Landlord saves a payment card and authorises Pop This Shop to charge it for amounts the Landlord owes under these Terms, in particular cancellation penalties (Section 7.2) and amounts due under Section 10.7. Before charging the card, we send an invoice. If an amount remains unpaid 30 days after the invoice, we may charge the card. A payment method that is still needed (for example while Listings are online or Reservations are open) cannot be removed.
6.6 Taxes and VAT
Landlords and Tenants are responsible for their own tax obligations arising from a Reservation. Pop This Shop charges VAT on its own fees where required: business customers with a valid VAT number in another EU country are invoiced under the reverse-charge rules, and other customers are charged Belgian VAT or VAT of their own country where the law requires it. VAT numbers are checked through VIES or the relevant national register.
Under Council Directive (EU) 2021/514 (“DAC7”), Pop This Shop is required to collect and report information about Landlords and the amounts they receive to the Belgian tax authorities. Landlords must provide the information we request for this purpose (such as tax identification number, date and place of birth, company number and, where applicable, the cadastral reference of the Space).
6.7 Self-Billing and Invoices
When Pop This Shop pays out an amount owed to a Landlord for a Reservation, that payout is documented by a self-billing invoice issued by Pop This Shop in the Landlord’s name and on the Landlord’s behalf, in accordance with Article 224 of the VAT Directive 2006/112/EC as implemented in Belgian VAT legislation. A Landlord gives its consent to self-billing in its account settings. By doing so, the Landlord agrees to accept each self-billing invoice issued in this way and not to issue a separate invoice of its own for the same Reservation. Issued invoices are never changed: any correction is made by a credit note.
6.8 Security Deposit
Where a Listing provides for a security deposit, that deposit is agreed and paid directly between the Landlord and the Tenant. Pop This Shop does not collect, hold or process any security deposit, and is not responsible for its return or for resolving any dispute about it.
7. Cancellations, Changes and Refunds
7.1 Cancellation by the Tenant
A Tenant may cancel a confirmed Reservation on the Platform. The refund depends on how long before the start date the cancellation is made, counted in calendar days on the amount already paid:
- More than 3 months before the start date: the rent and extras are refunded, together with 90% of the Administration Fee and the related VAT.
- Between 1 and 3 months before the start date: 50% of the rent and extras is refunded, together with 50% of the Administration Fee and the related VAT. The other 50% of the rent goes to the Landlord.
- Less than 1 month(s) before the start date: the extras and their VAT are refunded. The rent goes to the Landlord, and the Administration Fee is not refunded.
In every case the payment processing fee is not refunded, and a fixed cancellation fee of €75 (plus the payment processing fee on that amount) is charged.
7.2 Cancellation by the Landlord
If a Landlord cancels a confirmed Reservation, the Tenant receives a full refund, including all fees and VAT. The Landlord pays a cancellation penalty:
- More than 3 months before the start date: €150.
- Between 1 and 3 months before the start date: 50% of the Administration Fee, with a minimum of €250.
- Less than 1 month(s) before the start date: 100% of the Administration Fee, with a minimum of €300.
The Landlord also bears the payment processing costs of the Reservation and of the penalty. The penalty may be charged to the Landlord’s card (Section 6.5) or deducted from payouts.
7.3 Reasons, Changes and Events Beyond Control
The Member who cancels gives a reason on the Platform. Changes to a confirmed Reservation (dates, Space or price) require the agreement of both Members. If new dates cost more, the Tenant pays the difference; if they cost less, the difference in rent is credited and fees are not refunded. Where a Reservation cannot reasonably be performed because of an event beyond a Member’s control (such as measures by a public authority, extreme weather or a closure order), Pop This Shop may help the Members agree a fair adjustment, rebooking or refund, without prejudice to their rights under Applicable Law.
Refunds are made to the original payment method. Depending on the method and the bank, they usually arrive within 5 to 10 working days.
8. Tenant Responsibilities and Assumption of Risk
Tenants must use Space only for lawful purposes, in accordance with the Landlord’s rules and any conditions attached to the Listing, and must hold any licences needed for their own activity (for example, food-handling registrations or an alcohol licence). Tenants acknowledge that occupying temporary retail or event space carries inherent risks, and agree to take reasonable care and to hold adequate insurance, including public and product liability cover, for their own activities in the Space.
9. Insurance
Landlords are responsible for adequate property and public liability insurance for the Space they list. Pop This Shop does not provide insurance to Members and is not liable for loss of or damage to a Landlord’s property or a Tenant’s goods, except to the extent such liability cannot be excluded under Applicable Law. Damage and other disputes about the use of the Space are settled between the Landlord and the Tenant; Pop This Shop can help with the booking and payment side.
10. Content, Reviews and Platform Rules
10.1 Content Licence
By submitting Content, a Member grants Pop This Shop a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, translate, adapt and display that Content for the purpose of operating, promoting and improving the Platform. The Member keeps ownership of its Content and confirms that it has the rights needed to grant this licence.
10.2 Reviews
Only Members who completed a Reservation through the Platform can leave a review, on a scale of 1 to 5. Reviews must reflect the Member’s own genuine experience and may not be submitted or requested in exchange for compensation, in accordance with the review-authenticity requirements of the Omnibus Directive (EU) 2019/2161 as implemented in Book VI CDE. Reviews are not deleted at a Member’s request, but may be hidden in accordance with Section 10.4.
10.3 Prohibited Conduct
- Circumventing the Platform, as further described in Section 10.7.
- Sharing contact details, payment instructions or identifying information in a way that breaches Section 10.5.
- Providing false, misleading or fraudulent information in a Listing, review, message or Reservation.
- Harassing, discriminating against or acting unlawfully towards another Member, including on grounds protected under the Belgian Anti-Discrimination Act of 10 May 2007 and the Gender Act of 10 May 2007. Restrictions on the type of activity allowed in a Space are permitted.
- Publishing private information or identifiable images of third parties without their consent.
- Infringing the intellectual property or other rights of a third party.
- Listing or using Space for an unlawful purpose, or for the sale of prohibited, counterfeit or unlicensed goods.
- Creating more than one account to avoid a restriction, or using another Member’s account.
10.4 Notice and Action, Measures and Statement of Reasons
Members can report a Listing, Content or conduct they believe is unlawful or against these Terms, using the report options on the Platform or our contact form. Where Pop This Shop hides, restricts or removes Content, or restricts an account, it does so in accordance with Articles 16 and 17 DSA: the Member is told what was restricted and why, and can contest the decision through our internal complaint-handling system (Section 14).
10.5 Protection of Member Identity and Contact Details
To protect Landlords, Tenants and the Platform, contact details are shared step by step. Before a booking request, Members communicate only through Platform messages. From a booking request onwards, the names of the Members and the Tenant’s brand and project are shared with the other side. The exact address of the Space and the contact details are shared once the Reservation is paid, or 24 hours before a confirmed viewing in the viewing details. Pop This Shop may edit, mask, crop or remove any text, photo, attachment or other Content in a Listing or message that would disclose such information earlier, and may remove location data (such as GPS data) from uploaded photos.
10.6 Automated Checks of Messages and Content
To enforce these rules and to protect both sides, messages, attachments and other Content are checked automatically for contact details, payment details and arrangements outside the Platform. This check combines pattern recognition with an AI check. Detected contact or payment details are masked, and the sender is told what was hidden and why. Messages that are flagged may be read by our team. Repeated breaches are counted over a rolling period of 90 days and can lead to a reminder, a warning and a review by our team. Measures against an account are always decided by a person, never by an automated system alone. Messages may also be translated automatically so that both Members can read them; the original text is always available.
10.7 Protection Period and Off-Platform Agreements
10.7.1 Pop This Shop brings Landlords and Tenants together. During the Protection Period of 2 years from their First Contact, every Reservation, extension, renewal or repeat booking between a Landlord (or its Related Parties) and a Tenant (or its Related Parties), including for any other Space of the same Landlord, must be made and paid through the Platform.
10.7.2 If a Landlord concludes or accepts such an agreement or payment outside the Platform during the Protection Period, the Landlord owes Pop This Shop, for each agreement, a fixed compensation equal to one Monthly Rent, plus a fixed research fee of €250 for detecting and establishing the breach, and the costs of recovering the amount. The Landlord is jointly liable for its Related Parties. The amount may be set off against payouts or charged in accordance with Section 6.5.
10.7.3 Long-term leases are welcome. A Landlord and a Tenant may sign a written commercial lease of at least 1 year directly between themselves, provided that the Landlord declares the lease on the Platform within 14 days of signing, with a copy of the lease, and pays a buyout fee of one month's rent (excluding VAT) within 30 days of our invoice. A lease that is not declared is treated as a breach of Section 10.7.2.
10.7.4 This Section does not apply to a relationship between a Landlord and a Tenant that existed before their First Contact, if this is shown by written evidence dated before the First Contact.
10.7.5 To enforce this Section, Pop This Shop keeps a protected record of the contacts between each Landlord and Tenant from their First Contact, and may check publicly available information. This Section continues to apply after an account is closed.
10.8 Press Releases
See Section 11.3.
11. Additional Services
11.1 Featured Listings
Landlords and Tenants can book a Featured Listing for a fixed period at the price shown when booking (currently 7 days for €50, 30 days for €150 or 90 days for €375, plus VAT where applicable). Booking an extension adds the new period to the current end date. Featured Listings are marked as such. The booking is completed by payment and an invoice is issued.
11.2 Banner Advertising
Advertisers can book a Banner in one of the positions offered on the Platform, as a package of views or as a share of the views of that position, for one or more weeks, at the price shown when booking. A view is counted when at least half of the Banner is visible on screen; views by bots and by our team are not counted. A booking is reserved for a short time while payment is completed. After payment, every Banner is reviewed before it is shown. The review includes an automated check of the image, the text and the page behind the link (including an AI check) and a review by our team. Banners with a low risk level may be approved automatically; banners with a medium or high risk level are always reviewed by a person. We may reject or hide a Banner that breaches these Terms or Applicable Law, including Banners that offer one specific space or ask for a space (these belong in a Listing), advertise a competing platform, are misleading, or link to an unsafe or misleading page. Banners run during the booked period and end at the end of that period, also if a views package has not been fully delivered. Advertisers receive reports with percentages and totals; no data that identifies visitors is shared. If a Banner needs changes, we explain what to change and why, in the Advertiser’s language, and the Banner gets the status “Changes requested”: it is not shown and nothing is deleted. The Advertiser may then upload a corrected Banner in its account (My banners) within 7 days of our request, up to 2 times per booking, as long as the booked period has not ended. Each corrected Banner is reviewed again. The booked weeks stay the same: time lost because a Banner had to be corrected is not made up. If no compliant Banner is supplied within these limits, the Banner is rejected and the campaign ends. If our review of a Banner (also a corrected one) takes longer than two working days, we move the campaign to the next available week. Once a Banner is approved, it can no longer be changed. The review starts as soon as the booking is paid and is part of the service, so the payment is not refunded when a Banner is rejected because it breaches these Terms or Applicable Law, including when no compliant Banner is supplied within these limits.
11.3 Press Releases
Tenants with a confirmed Reservation may receive a free press release about their pop-up, prepared by Pop This Shop on the basis of the information the Tenant provides within the requested time. The Tenant approves the text before it is sent. Pop This Shop selects the media to which the press release is sent and may publish it in its online newsroom, without the Tenant’s contact details. Pop This Shop does not guarantee that a press release will be published or picked up by any media, and is not responsible for its further follow-up. If a press release is delayed through our own fault, we offer a recap post or success story instead.
11.4 Success Stories and Social Media
Pop This Shop may feature any pop-up booked through the Platform, at any time, during and after the pop-up, as a success story on the Platform, in its newsletters and on its social media (such as Instagram, Facebook, LinkedIn and TikTok). For this, Pop This Shop may use the texts, photos and logo the Tenant provided for its press release or tenant listing, under the licence in Section 10.1, and tag the Tenant’s brand on the social media accounts the Tenant gave. Photos from Concept Listings are not used for this purpose, so a Concept Listing stays anonymous. A Tenant who wants a specific photo no longer used can tell us, and we will not use it in new posts.
11.5 Promotional Codes
Pop This Shop may offer promotional codes, for example a free Featured Listing or Banner during a launch period. Each code is subject to the conditions shown with it (such as one use per account and a maximum duration) and cannot be exchanged for money.
12. Intellectual Property
The Platform, including its software, design and the Pop This Shop name and logo, is owned by or licensed to Pop This Shop and is protected by intellectual property law. Nothing in these Terms transfers any such rights to a Member, other than the limited right to use the Platform in accordance with these Terms.
13. Closing an Account, Suspension and Other Measures
A Member can close its account at any time in its account settings, provided there are no running Reservations or amounts due. When an account is closed, the Member can no longer log in, and its Listings, profile and reviews are removed from the Platform straight away. Some information is kept for a limited period, for example invoices and tax information as required by law, and Reservations, messages, rental agreements and related records for up to five years after the last Reservation or contact, as explained in our Privacy Policy. A closed account can be reopened through the link in the confirmation e-mail for a short period.
Pop This Shop may restrict, suspend or close a Member’s access to the Platform for a breach of these Terms, fraud, or where required by Applicable Law. Where a Member is a business user within the meaning of the P2B Regulation, Pop This Shop will give a statement of reasons and, except where a shorter period is justified by a legal obligation or repeated breaches, at least 30 days’ notice before ending the services entirely, in accordance with Article 4 of that Regulation.
14. Complaint Handling
Members can submit complaints about a Listing, a Reservation, a measure we have taken or any other matter through our contact form. Each message receives a ticket number. Complaints are handled free of charge, by a person, within a reasonable time, in line with Article 11 of the P2B Regulation and Article 20 DSA where applicable.
15. Changes to These Terms
Pop This Shop may change these Terms from time to time. Except where a change is required by Applicable Law or is solely favourable to Members, we give at least 15 days’ notice of a material change by e-mail or on the Platform. If you do not agree to a material change, you may close your account free of charge before the change takes effect. Continued use of the Platform after a change takes effect means that you accept the amended Terms.
16. Disclaimer
Pop This Shop gives no warranty, express or implied, in relation to the Platform, a Listing, a Space or a Reservation. The Platform is provided “as is” and “as available”. To the extent permitted by Applicable Law, Pop This Shop does not warrant that the Platform will be uninterrupted, secure or error-free, and does not warrant the accuracy of a Listing, the identity of any Member, or the suitability of any Space. This Section does not affect any warranty that cannot be excluded or limited under mandatory Belgian or EU consumer law.
17. Limitation of Liability
To the extent permitted by Applicable Law, Pop This Shop’s total liability arising out of or in connection with these Terms or a Member’s use of the Platform is limited to the greater of the fees paid to Pop This Shop by that Member in the 12 months before the event giving rise to the claim, or €500, and Pop This Shop is not liable for indirect or consequential loss.
Nothing in these Terms excludes or limits liability for fraud, for death or personal injury caused by negligence, for wilful misconduct or gross negligence, or for any other liability that cannot lawfully be excluded or limited, including under Article VI.83, 13° CDE.
18. Indemnification
A Member agrees to indemnify Pop This Shop against reasonable claims, losses and expenses arising from that Member’s breach of these Terms or of Applicable Law, except to the extent such claims arise from Pop This Shop’s own gross negligence or wilful misconduct, or to the extent such an indemnity would be unenforceable against a consumer under mandatory Belgian or EU law.
19. Data Protection and Privacy
Pop This Shop processes personal data in accordance with the GDPR and the Belgian Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data. Our Privacy Policy explains the purposes and legal bases of processing, the automated checks we use, retention periods and your rights. Where a Landlord and a Tenant exchange personal data with each other for a Reservation, each acts as an independent controller for that exchange and is responsible for its own compliance with the GDPR.
20. Governing Law and Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by the laws of Belgium.
Where a matter is regulated by directly applicable European Union law (including the GDPR, the DSA and the P2B Regulation), that law applies and takes precedence over any conflicting provision of Belgian law.
Where a Member is a consumer habitually resident in another EU or EEA Member State, the choice of Belgian law does not deprive that consumer of any protection under the mandatory rules of the law of their country of habitual residence, in accordance with Article 6(2) of the Rome I Regulation (EC) No 593/2008.
Subject to the above, the courts of Antwerp, Belgium, have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, without prejudice to the right of a consumer to bring or defend proceedings before the courts of their own place of residence in accordance with Articles 17 to 19 of the Brussels Ia Regulation (EU) No 1215/2012.
21. Complaints and Alternative Dispute Resolution
Members should first raise a complaint through our internal complaint-handling system described in Section 14. The European Commission’s Online Dispute Resolution platform stopped operating on 20 July 2025. Consumers in Belgium may contact the Consumer Mediation Service (Consumentenombudsdienst / Service de Médiation pour le Consommateur, www.consumentenombudsdienst.be) or another qualified entity for consumer mediation. Pop This Shop is not obliged to use an alternative dispute resolution entity within the meaning of Directive 2013/11/EU, but will consider genuine requests for mediation in good faith.
